Please describe the nature of the stratum immediately beneath the material to be mined in <br />sedimentary deposits and the effects of this stratum on plant growth and revegetation <br />potential. <br />6. The mining plan under Exhibit D states that a diesel fuel tank may be mobilized with <br />mining equipment. Please note that the following policies aze in effect for all DRMS <br />permitted sites: All petroleum and/or hazardous material storage tanks on site for any <br />period of time shall have secondary containment. A lined berm must be constructed <br />around non-double-walled tanks to remain on site. The dimensions of this bean must be <br />capable of containing all contents of the tank (when full} plus 10% of the tank's capacity. <br />The liner shall cover the entire contaimnent basin as a barrier to infiltration. <br />7. Please state the owner of record for all existing impoundments, cattle pens, and fencing. <br />If the owner of record for these structures differs from the owner and operator of this <br />proposed permit, then procedures listed under Rule 6.3.12 must be followed. The owner <br />of record must be listed, along with the following if the owner of record is not the <br />operator/applicant; <br />a. Where the mining activities will adversely affect the stability of any significant, <br />valuable and permanent man-made structure located within two hundred <br />(200) feet of the affected land, including gas, water, power lines, fences, roads, <br />wells, ditches, and any below-ground utilities, the Applicant shall either: <br />i. Provide a notarized agreement between the Applicant and the <br />Person(s) having an interest in the structure, that the Applicant is to <br />provide compensation for any damage to the structure; or <br />ii. Where such an agreement cannot be reached, the Applicant shall <br />provide an appropriate engineering evaluation that demonstrates <br />that such structure shall not be damaged by activities occurring at <br />the mining operation; or <br />iii. Where such structure is a utility, the applicant may supply a <br />notarized letter, on utility letterhead, from the owner(s) of the <br />utility that the mining and reclamation activities, as proposed, will <br />have "no negative effect" on their utility. <br />Rule 6.4.5 Exhibit E- Reclamation Plan <br />8. The Division received comments regazding this amendment finm various agencies. These <br />comment letters are being provided to the operator now and aze enclosed with this <br />adequacy letter. Please address these comment letters as necessary. <br />9. Please confirm that if topsoil stockpiles aze to be left in place for one year or longer, the <br />temporary seed mixture, as recommended by MRCS, will be applied. <br />10, Please provide anticipated quantity (cubic yards) of construction stockpile material on- <br />site at all times. <br />11. The applicant's reclamation plan map illustrate that the final reclamation slopes at <br />various points across the pit will be mined at slopes of lh:ly. A reclaimed slope of <br />steeper than 3hav will be difficult to stabilize and revegetate and does not support the <br />postmining land use of rangeland. Due to these constraints, the Division will not approve <br />a reclaimed slope of steeper than 3h:ly. However, the Division will accept 3h:ly slopes. <br />Please revise the reclamation plan and map accordingly. <br />2 <br />
