Loye, <br />This letter is in response to yours of April 2, 1986. We will <br />respond to your concerns in the order presented. <br />We will notify the Colorado Department of Highways on April <br />14th as discussed with you last Friday. All other legal <br />notices have been delivered to you. <br />Exhibit C - Pre-minim and hlinin~ Plan Map <br />1. Enclosed is a sketch map transcribed in part from the <br />~,g exhibits submitted with the application. The map is <br />~wP~ identified as Exhibit C-3 and represents a very close <br />`r~~..J~d approximation of the existing topography within both <br />~P CT~,the 110 area and the 111 area as well as the presently <br />'~^ PD~rc~~~undisturbed additional acreage. <br />2. We anticipate having only one topsoil stockpile in the <br />course of mining. As described in the narrative of the <br />Mining Plan and Reclamation Plan, the operator will <br />scrape topsoil once a year from the area immediately <br />subjected to mining and in a single operation redistri- <br />bute the tbpsoil material to the rear for final seed- <br />bed preparation and seeding. (The Caldwell Brothers <br />have all necessary equipment and propose to promptly <br />reseed as set forth in the Reclamation Plan). <br />3. Please see the boundaries as shown on Exhibit C-3, <br />Exhibit D - Mining Plan <br />1. The letter requesting release of the financial warranty <br />and the 111 permit by HLM will be forthcoming. <br />2. The adjacent permanent industrial site has been permitted <br />by Otero County to HLhl Construction. Currently, fines <br />material has been transported onto the site from Lamar, <br />Colorado for blending into material produced in part from <br />the Caldwell site. Next year, a batch plant operated by <br />HLht approximately one mile northeast of the industrial <br />site will be relocated at the new site in question. <br />At all times, HLNI expects to import material from other <br />locations in addition to that secured from the Caldwell <br />pit. Clearly it is not a single source operation, <br />3. The deleted area is completely removed from any currently <br />disturbed area. The deleted area represents a low swale <br />area surrounded in part by old river deposits of mounds <br />or hillsides of gravel from ancient times. <br />
