NlLTON, Dinetor <br />G <br />T0: Joe Oliver <br />~/~~ ~~ <br />FROM: Jim Pendleton <br />DATE: October 24, 19 4 <br />RE: Technical Revision Application -Eagle No. 5 and No. 9 Underground Coal <br />Mines <br />Empire Energy Corporation is requesting a technical revision to pursue the <br />construction of an overland conveyer crossing of the Williams's Fork River and <br />Colorado Highway No. 13/789. This construction will involve the construction <br />of a temporary access road, laydown yard and the operation of a structural <br />crane within the active channel of the Williams's Fork River. <br />The construction of the tube conveyer enclosure will prevent coal fine <br />pollution of the Williams's Fork River. For this reason, carefully controlled <br />minor disturbance of that channel would appear to be warranted. However, the <br />information presented by the applicant within the technical revision <br />application is extremely vague in reference to the conditions within and <br />atljacent to the channel of the Williams's Fork River. <br />The temporary road and laydown areas would appear acceptable as proposed. As <br />the applicant observes, a specific permit will be required from the Colorado <br />Department of Highways, because the proposed disturbance lies within the <br />highway right-of-way. The Division should condition approval of the technical <br />revision upon receipt of the appropriate Colorado Highway Department Utilities <br />Permit. <br />The more critical component of this technical revision appli~ration involves <br />the need for a crane to work within the channel of the Williams's Fork River <br />while the conveyer enclosure tube is being placed over the river. It will be <br />important to minimize disturbance to that channel and the adjoining areas. <br />The applicant presents two access alternatives which include possible <br />placement of fill as a pad for the crane or excavation of a ramp in the river <br />bank. The scale of Map IV - 9 does not allow determination of the actual site <br />configuration in the immediate area of the proposed channel disturbance. <br />Applicant should provide the Division with a construction scale site map <br />(perhaps one inch equals twenty feet) and an appropriate contour interval such <br />as one foot.
