To begin with Stipulations 8, 9, 11 and 12 deal <br />with surface and water analysis. Wyoming Fuel Company (WFC) will send in <br />an annual hydrologic report. The report will include all information <br />required by the stipulation and an analysis of the information. If WFC <br />would like a reduction in the m oring program, a request should be <br />made at that time based on th results of the year's worth of data. The <br />report is to be submitted by February 1, 1983. <br />In response to Stipulaton 13 you stated that alternative three is the <br />approach you would like to take. Therefore, WFC will submit a plan by <br />February 1, 1983. <br />WFC will revise the permit application as required by Stipulation 15. <br />This change will be incorporated by February 1, 1983. <br />A preliminary report on the alkalai sayebrush community was submitted to <br />the Division. The report provides production data from the affected area <br />and the reference area, as required by Stipulation 17~ The report has <br />been reviewed by the Division. Both samples reached sample adequacy and <br />it was determined that the two areas are statistically Comparable. <br />Therefore, the Division finds the information is acceptable. WFC must <br />submit the report in final form by February 1, 1983. Unce the final <br />report is submitted this stipulation will be satisfied. <br />Stipulation 18 requires a species diversity standard. WFC committed to <br />the standard proposed in Mike Savage's April 7, 1982 letter with the <br />following qualification. In the event the re vegetation monitoring <br />program shows the relative importance of a single species is exceeding <br />the maximum level, WFC will contact the Division. A mutually agreed on <br />solution will be developed. The Division accepts this qualification. <br />Therefore, Stipulation 18 is satisfied. <br />d29 Centennial Building, 131?
