~` <br />~~ <br />Mr. Dave Stout Page 2 January 5, 1983 <br />With regard to Stipulation 19, WFC agrees to reestablish woody plant <br />density so that the reclaimed density is at least 90% of 3,770 with 80% <br />confidence, i.e. 3,770 ± 1,700. The Division finds the standard <br />acceptable. To properly evaluate the reclaimed density an adequate <br />sample must be taken. <br />The Division is unable to locate the response to Stipulation 20, although <br />apparently it was submitted a couple of months ago. WFC agreed to send <br />in a copy by February 1, 1983. <br />WFC agrees to the requirements of Stipulation 21 regarding sage grouse <br />mitigation. Fbwever, they have prepared an analysis of the effects of <br />coal mining on the habitat. Although not required, WFC will submit this <br />analysis and also suggested we call WFC if the Division wants to further <br />discuss the issue. <br />WFC has not responded to Stipulation 24. This is an annual monitoring <br />requirement regarding the anticipated swell factor. Techniques <br />acceptable to the Division must be utilized and thus far the Division has <br />received nothing. Therefore, a response to this stipulation must be <br />submitted by February 1, 1983. <br />To summarize responses concerning stipulations 8, 9, 11, 12, 13, 15, 17, <br />2U, 21 and 24 will be submitted by February 1, 1983. Stipulations 18 and <br />19 are now considered satisfied. <br />Recent bond cancellation notices were also discussed.
