As you <br />know, Mr. Stone has backfilled, topsoiled and seeded a portion of the <br />disturbed area at the gravel pit. Our expectation for a reclamation <br />fence is to keep cattle off the reseeded area to allow seedling <br />establishment. Successful seedling establishment normally requires <br />two growing seasons to complete. The fence, capable of turning <br />livestock, should be constructed before October 15, 1999. In review <br />of the approved permit from the State of Colorado we do not see a <br />specification for the length of time the fence is to remain. We would <br />further request that the fence be maintained through the second <br />growing season, or until BLM is satisfied vegetation is adequately <br />established. After that time the fence should be removed by Mr. <br />Stone. The earliest projected date for removal of the fence would be <br />October~l5, 2000. Should unauthorized livestock use occur between now <br />and October 15, 1999, keeping livestock off the reclaimed area(s) <br />would be Mr. Stone's responsibility. <br />There are dogs in a pen located in the working area, which Mr. Stone <br />has stated are required for security for the gravel pit. We verbally <br />requested that Mr. Stone remove the dogs from the site, since we have <br />had a complaint regarding barking dogs at night. This appears to be a <br />surface occupancy issue. We do not read anywhere in the approved <br />mining permit having penned dogs for security. We have not received <br />any notification from your Division regarding this plan modification. <br />Unless your Division modifies the permit, we shall pursue our normal <br />occupancy trespass procedures to resolve this issue. <br />Should you disagree with our clarification of issues, please do not <br />hesitate to call or write at your earliest convenience.
