Upon further visits we find that <br />you have not removed the dogs and the dogpen, and to our <br />knowledge, no permit modifications have been submitted. The pen <br />and the dogs constitute a surface occupancy which is in trespass <br />under 43 CFR 9239.2-1. It is unlawful to place a permanent or <br />temporary structure of this sort on public lands. The dogpen is <br />not authorized as part of your mining operations. You have no <br />permit from BLM authorizing this surface occupancy and have made <br />no application. Therefore, you have until February 1, 1999 to <br />remove the unauthorized dogs and the pen. After that date we <br />will pursue our prosecution of the trespass with the U. S. <br />Department of Justice. If the dogs and pen are removed by the <br />above date you will not be required to pay any penalties or <br />trespass fees. <br />We ask your immediate attention to this problem.
