Long <br />Division Director <br />No C-81-033 nd C-80-007 <br />Thank you for your telephone call of December 3, 1993. You asked several questions <br />regarding the permitting process and ongoing permitting actions at the <br />above-referenced mines. The following will hopefully answer your questions, but if <br />I have missed something, please give me a call. <br />GENERAL <br />I have included a copy of our Law and Regulations. The public review portions <br />are mainly found at Rule 2.07.1. In general, the operator must publish a <br />notice at the beginning of most permitting processes, and this Division <br />publishes a notice at the end of the process. Any member of the public, <br />especially a potentially affected landowner, can participate in the permitting <br />process. While a specific letter is not normally sent to each mineral or <br />landowner during most permitting processes, I have written both Bear Coal Co. <br />and Mountain Coal Co., and requested that they notify you directly if any <br />future permit revision process will affect your property (letter copies <br />attached). <br />Typically, public review copies of all new permitting actions are maintained at <br />the local County Clerk and Recorder's office. All approved materials are <br />stored at the mine sites, and are available for public review. We also <br />maintain full copies of all materials at our Denver location. <br />BEAR MINE <br /> <br />I believe that the newspaper publication you referenced, is the completeness <br />publication for the Bear Mine Technical Revision 17. This publication is the <br />notice provided at the beginning of the process. This particular technical <br />revision proposes minor changes to the Bear Mine permit boundary along the <br />North Fork of the Gunnison River. Some minor clarifications are also provided <br />for the facilities area. A copy of the actual revision materials are available <br />at the Clerk and Recorders' Office in Delta, or here in Denver.
