Landau James S.Lochhead <br /> Cotter Corporation Executive Director <br /> 12596 West Bayaud Avenue MichaelDir`e <br /> Suite 350 <br /> Lakewood, CO 80228 <br /> RE: Conditional Withdrawal of Pending Designated Mining Operation <br /> Determination, Ike No. 1, Permit No. M-77-451 <br /> Dear Mr. Landau: <br /> Pursuant to our discussion during the April 18, 1995 meeting, the Division has <br /> decided to conditionally withdraw the pending DMO determination for the Ike No. 1. <br /> After careful consideration of the existing condition at the site, future plans of the <br /> operator and a review of the evidence and documentation, the Division feels the initial <br /> DMO determination may have been submitted to the operator prematurely. <br /> The facts are: <br /> 1. The Ike No. 1 permit application was submitted to the Division in <br /> October, 1977. <br /> 2. A 110(2) permit was issued in February, 1979 covering 2 acres. <br /> 3. Approximately 1.8 acres, of the 2 acre permit, were disturbed. <br /> 4. The operator added 11.3 acres to the permit when it was converted to a <br /> 112 in October, 1990. <br /> 5. During an inspection of the site in September, 1993 the inspector <br /> observed: <br /> a. The 11.3 acre addition to the permit had never been disturbed. <br /> b. All but .17 acres of the original 2 acre permit has been reclaimed. <br />
