Some of the issues which you raise are outside of the <br />purview of this agency. Therefore, we recommend that you pursue issues two, three and <br />five with the Mine Safety and Health Administration. This letter is the Division's response <br />to the remaining questions. <br />Response to Question No. 1: <br />As stated in our letter to Mr. Mike Ossola, dated December 3, 1992, there was insufficient <br />evidence at the time of the November 17, 1992 inspection to conclude that the trees were <br />dying and that the exhaust from the fan may be contributing to their demise. <br />However, an inspection conducted on January 13, 1993 revealed that two trees directly in <br />front of the exhaust fan were now showing signs of stress. Comparison of photographs <br />taken at the time of the two inspections may reveal whether additional trees being <br />affected. <br />Response to Question No. 2: <br />Concerns about potential impacts to public health and safety that might be caused by the <br />Golden Eagle Mine as a result of mine ventilation may be addressed to the U.S. Mine <br />Safety and Health Administration (MSHA1.
