Box 635-Caribou <br />Nederland, CO 80466-0653 <br />RE: Cross Gold Mine Operation/Echo Bay Exploration 1995 <br />Dear Mr. Hendricks: <br />The Division has received and reviewed your letter of June 7, 1995. <br />It is commendable that you will be keeping the drill pad sites to <br />under 40' X 40'. <br />However, a Notice of Intent to Conduct Prospecting (NOI) will need to <br />be filed since drilling is to be done. Rule 5.4(1) of the Minerals <br />Rules and Regulations state, in part, "Without regapd to the one <br />thousand six hundred (1,600) square foot limitation of the Act, all <br />drill holes sunk (drilled) for the purpose of prospecting for <br />locatable or leasable minerals shall be permanently plugged, ;sealed or <br />capped pursuant to the requirements of this section immediately <br />following the drilling of the hole and the collection of drill hole <br />information...). The Division has no way to track whether drill hole <br />abandonment has been conducted in the proper fashion anti cannot <br />reasonably require proper drill hole abandonment unless a NOI is filed <br />and adequate bond held. This requirement would not apple 'to holes <br />drilled within the present permit boundary nor to holes drilled fbom <br />within underground mine workings, among other things (see Rule <br />5.4(2)).
