Shelton <br />Director <br />I would Zike to take this opportunity to thank you for your contribution <br />I to the productive meeting we had yesterday, regarding both the mining of <br />the Dam D area and the reclamation of the "prospecting pit", and to document <br />a few of the major topics we discussed. <br />We reviewed the general plan you submitted in your Letter of December 9, <br />2980 for mining the Dam D area and agreed that the discussion of the <br />diversion pipe installation should be modified for clarification as should <br />Che discussions of the backfilling plan, sediment pond construction, and <br />stream channel reconstruction. The modifications we discussed were mutually <br />acceptable and will be submitted for review as soon as possible. I agreed <br />to make every effort possible to review the balance of the plan and the <br />attached calculations by December 29, 1480 so that the economics of mining <br />and reclaiming that corner will be as favorable as possible for GEC, <br />The primary purpose of our meeting was to begin to resolve the deficiencies <br />in the reclamation plan for the "prospecting. pi t" as they were identified <br />in my letter to GEC dated December 12, 1980. <br />You requested for GEC an interpretation of the small business exemption you <br />had discussed with Chips Barry and Dean Massey in the fall of 1979. I <br />have spoken with Chips and he concurs with my interpretation that Sec 502 (c) <br />of the Surface Mining Contzol and Reclamation net of 1977 was a limited time <br />exemption providing extra time (until January 1, 1979) for small operators <br />to come into compliance with all the performance standards of the Act, All <br />other operators had nine months from the date of approval of the Act to come <br />into compliance...sma11 operators had until January 1, 1979.
