Cicia: <br />oF' cow <br />r,~ 9 <br />,~,e' <br />e <br />r8ib ~ <br />Roy Romer <br />Governor <br />Michael 8. long <br />Division DlreClol <br />The Colorado Division of Minerals and Geology is preparing the bid document for final reclamation <br />of the revoked Trinidad Basin Mine (TBM) site. The Division mailed a letter to you dated <br />October 15, 1993, in which the Division requested verification of property ownership boundaries. <br />The Division has not received a response to our letter dated October 15, 1993. The purpose of <br />this second letter is to describe the reclamation activities that the Division proposes to conduct <br />on lands that may be owned by you. If the Division does not receive a response to this letter by <br />February 13, 1994, the Division will assume your consent and proceed with the plan described <br />herein. <br />Enclosed are two maps titled Map I and Map II. Map I shows the area that Division records <br />indicate portions of which are owned by you. Land ownership records indicate overlapping <br />boundaries of ownership for the entire E'/~ of the E%x of Section 15 within the permit area. Map I <br />also shows the area covered by the second map, Map II. Map II highlights the location of <br />reclamation activities proposed by the Division that may affect property owned by you. The <br />circled red numbers on Map II correspond to the numbered items of this letter. The reclamation <br />items listed in this letter have been characterized as possessing high, medium, or low priority <br />based upon the Division's determination of potential environmental degradation and threat to <br />public safety. The Division has prioritized the reclamation items in the event that sufficient bond <br />is not available to complete reclamation of all items listed for the entire mine site. <br />Proposed Reclamation Plans /Numbered items correspond to Map ll/ <br />1 . Pond 15-P11 was not approved as a permanent pond in the approved reclamation plan; <br />however, removal of pond 15-P1 1 would necessitate installation of an additional culvert <br />under the county road and would increase sediment loading of Del Agua Creek. The Division <br />proposes to leave pond 15-P11 for sediment control and to provide water for wildlife and <br />livestock. The approved post-mining land use is rangeland and wildlife habitat; therefore, <br />leaving pond 15-P11 would improve the land for its intended land use. The Division proposes <br />to lower the elevation of the secondary spillway and replace the protective riprap lining of the <br />secondary spillway. Priority has been characterized as medium. <br />
