Pond 15-P12 was not approved as a permanent pond in the approved reclamation plan; <br />however, removal of pond 15-P12 would necessitate installation of an additional culvert <br />under the county road and would increase sediment loading of Del Agua Creek. The Division <br />proposes to leave pond 15-P12 for sediment control and to provide water for wildlife and <br />livestock. The approved post-mining land use is rangeland and wildlife habitat. Leaving <br />pond 15-P12 would improve the land for its intended land use. The Division proposes to <br />lower the elevation of the secondary spillway and replace the protective riprap lining. Priority <br />has been characterized as medium. <br />The unreclaimed mining disturbance at this location covers an estimated area of 7,500 square <br />feet and has one highwall that is approximately 25 feet tall. The Division has determined that <br />this disturbance did not result from operations conducted by TBM; as such, the expenditure <br />of monies from the forfeited TBM bond will not be used for reclamation of this disturbance. <br />The Division proposes to leave this disturbance in its present condition at this time. <br />4. The unreclaimed mining disturbance at this location covers an estimated area of <br />80,000 square feet and has one highwall that is approximately 30 feet tall. The Division has <br />determined that this disturbance is not related to operations conducted by TBM. The Division <br />will not be utilizing funds from the bond forfeited by TBM for reclamation of disturbances not <br />associated with the TBM permit. The Division proposes to leave this disturbance in its <br />present condition at this time. <br />The Division has determined that the small disturbance at this location did not result from <br />TBM operations; as such, the expenditure of monies from the forfeited TBM bond will not be <br />used for reclamation of this disturbance. The Division proposes to leave this disturbance in <br />its present condition at this time. <br />Thank you for your cooperation. If the Division does not receive your response to this letter by <br />February 13, 1994, the Division will assume your consent and proceed with the plans described <br />herein.
