<br />' <br />: iii iiiiiiiiiiiiiiii <br />999 <br />~ <br />~~~~~~~ <br />February 19, 1986 FEB 2 2 ~ <br />Hined Land Reclamation Division <br />Department of Natural Resources <br />1313 Sherman Street - Room 423 <br />Denver, CO 80203-2273 <br />RE: Reclamation and Bond Reduction Memo <br />Ladies and Gents: <br />•:.~,_ <br />This is to restate and recap our position regarding reclamation and <br />bond reduction on Sun Coal's lease of our land. <br />During the past nine (9) years the Office of Surface Mining (OSM) <br />and Che Colorado Mined Land Reclamation Board (CMLRB) has approved <br />various projects and practices performed by Sun Coal Company (division <br />of Massey Coal Company, Richmond, Virginia) which have been disasterous <br />and destructive. In addition the subjects named herein have increased <br />costs to Sun Coal and the consumer. Alternative plans and suggestions <br />submitted by the land owner have always been rejected. <br />Sheriff reports, medical data, Channel 4 Denver Television Station <br />and court records are available to ateat to our claims. <br />1. Rick Brown of Sun Coal was forced to mulch-seed haul road and <br />other slopes, cost 518,000.00. Results were very poor. Suggestions by <br />land owner were and continue to be ignored. <br />2. Sun Coal was forced to install an electric fence around what <br />was described as the permit area. Steel posts and smooth wire strung <br />over the area through sage brush proved to be a hazard to horses sad <br />riders. Hired hand and land owner injured when horses became entangled <br />in wire. Same steel posts still in place in spite of many <br />notifications. <br />3. Forced Sun Coal to divert water and install a pond at the river <br />destroying land owners airfield, and prime grazing land. Three years of <br />so called reclamation, land and airfield still unusable. Land owners <br />requests ignored. <br />4. Water was diverted south of Sun Coal's shop onto meadow causing <br />erosion and covering grass. Never corrected in spite of numerous <br />requests. Sun Coal was recently directed, again by the Division, to <br />reinstall the drainage so as to do more damage. Also installed berm <br />drainage so that water goes into or through shop, making it difficult to <br />use. The Division also failed to halt drainage past the stone house <br />destroying a large portion of the meadow each year. <br />5. The OSN and the CMLRB by their failure to adopt landowners <br />suggestions caused Sun Coal to build a pond over an old abondoned <br />
