J <br />•^ <br />underground coal mine rasa-Ming in a mud elide that ruptured the gas <br />line to Steamboat Springs. This 14 hour gas service interruption in <br />May, 1980 cost ;50,000.00 to repair. The land and oil yell damage was <br />never corrected. Now the OSH and CMLRB has approved the same debauchery <br />at another location on the ranch. <br />6. The CMLRB condoned and approved the destruction of a cement pad <br />which the land owner had requested be left for his ranch use. The <br />contract still calls for structures (that which is built - real estate) <br />to be left intact. <br />7. The OSM and CMLRB have continued to ignore, belittle, and <br />otherwise fail to solve the "off permit" drainage problems which has <br />caused: the known death of six deer, five calves, destruction of 18 <br />beaver ponds, injury to human beings (3 cases), investigation of child <br />disappearance, and damage Co roads and dams. <br />8. The CMLRB forced the land owner to refill a drainage ditch <br />which he had constructed to use his water after it had left Sun Coal's <br />haul road. Said ditch was not in the permit area. Corrective (?) work <br />(30 day limit) ordered by a Mr. Munson, restoring Che old ditch (done by <br />Sun Coal) was responsible for killing yet another calf. Land owner was <br />also prohibited from using a small amount of water from the haul road <br />side ditch to irrigate nearby trees. Attempts to mediate by <br />consultation (with Division Representative) and letter were ignored. <br />9. The OSM and CMLRB by refusing to consider alternative plans <br />approved and ordered the destruction of the haul road ($800,000.00). <br />Special equipment is needed to plow snow which cannot be pushed off the <br />road as now constructed. Road is nearly impassible except in summer or <br />frozen, The installation of 80, 1'x15' water bars and ripping of road <br />has destroyed Sts full usefullneas. <br />10. The OSM and CMLRB forced Sun Coal to change the drainage in the <br />mined area so as to increase the angle of slopes, change the direction <br />of water flow, increased water flow off Grassy Creek land onto this <br />writer's lend. The changes made are radical and far exceed the CMLRB's <br />own requirements as judged by those forced on the land owner (see <br />paragraph 8) by court order. <br />11. There is also the killing of eight cattle caused by the Army <br />Corps of Engineers ordering Sun Coal to change the river channel. <br />Another example of bombastic bureaucratic bungling. Who pays for this <br />damage? <br />Suggestions and plans submitted by the land owner who is an <br />experienced heavy equipment operator, pilot, former Army officer, <br />rancher and contractor, are ignored by OSM and CMLRB. We have hired <br />attorneys and engineers who have generally agreed with our plans and <br />assessments, to no avail. We are firmly convinced that the OSM and <br />CMLRB is only interested in fostering their experiments, justifying or <br />holding their job and in general building another empire. <br />
