Rules 4.05.6(11)(8) and 4.05.9(8) require that pond embankments be vegetated or <br />stabilized by other means. I reviewed the DMG inspection reports for 1994, and found <br />comments documenting the lack of vegetation on the pond embankment for reports <br />dated 1/11/94, 2/9/94,5/25/94,7/19/94, 9/29/94, 10/25/94, and 12/7/94. In the <br />9/29/94 report, the Division requested that the embankment be reseeded with mulch <br />and net applied during the 1994 fall seeding season. Please submit by January 20, 1995 <br />written statement describing revegetation efforts taken for the embankment and also <br />state how Landmark Reclamation intends to comply with 4.05.6(11)(8) and 4.05.9(8). <br />4.05.9(8) Faces of embankments and the surrounding areas shall be vegetated or <br />stabilized by other means. Where water will be impounded, the active, <br />upstream face of the embattkntent shall be riprapped or otherwise stabilized, <br />in accordance with accepted design practices if necessary to protect against <br />erosion from water or wind action or sudden drawdown. Adequa[e freeboard <br />shall be designed and maintained to prevent overtopping by waves or by <br />sudden increases in volume. /f the chosen stabilization method is vegetation, <br />seeding will occur in accordance with the approved seeding plan. <br />4.05.6(11)(8) Faces of embankments including the surrounding areas disturbed by <br />construction shall be vegetated or stabilized by other means. The active <br />upstream face of tl:e embankment I+~here water is being impounded may be <br />riprapped or otherwise stabilized in accordance with accepted design practices <br />If the chosen stabilized in accordance with accepted design practices. /f the <br />chosen stabilization method is vegetation, seeding will occur per the approved <br />seeding schedule. <br />
