<br />Mr. Mazk Kerr 2 C - 89 - 074 <br />2. Inspection reports dated 11/10/94 and 12/7/94 contain comments documenting the <br />west side pond inslope being near vertical and potentially unstable. The west side <br />inslopes aze excavated from native ground and are therefore addressed by Rule 4.05.9(6). <br />4.05.9(6) Excavations that will impound water during or after the mining operation shall <br />have perimeter slopes that are stable and shall not be steeper than O.Sf::lv. <br />Where surface nutof f enters the impoundment areq the side slope shall be <br />protected against erosion. Excavated impoundments will meet all applicable <br />requirements of 4.05.9. <br />Please ensure that the excavated inslopes of the pond not only comply with 4.05.9(6), but <br />also conform to the designs approved in the permit. Please submit by January 20, 1995 a <br />written statement describing how Landmark Reclamation intends to comply with <br />4.05.9(6) and with designs approved in the permit for the excavated pond inslopes. <br />3. Rule 4.05.6(3)(c) requires that sediment ponds have a nonclogging dewatering device. <br />The primary spillway (four-inch diameter metal pipe) does not have a brush guard <br />installed at its inlet end. On July 27, 1994 Landmark Reclamation submitted an <br />application to install a brush guard through MR-06. On August 2, 1994 the Division <br />found the application for MR-06 incomplete due to the missing hydrologic <br />demonstrations to show that the proposed brush guard design would not diminish the <br />capacity of the spillway. The Division has yet to receive the required hydrologic <br />demonstrations for a brush guard design. Please submit by January 20, 1995 the <br />hydrologic designs and demonstrations for the nonclogging dewatering device required by <br />4.05.6(3)(c). <br />4.05.6(3)(c) Provide a nonclogging dewatering device or conduit spillway to remove water <br />storage resulting from inflow. The dewatering device shall not be located at a <br />lower elevation than fire maximum sediment storage volume.
