SIMPSON <br />Acting State Engineer <br />Re: Kauffman Pit, MLRD M78327 Substitute Water Supply Plan <br />NE 1/4 8 SE 1/4 Section 20, NW 1/4 & SW 1/4 Section 21, T5N, R68W, 6TH PM <br />Water Division 1, Water District 4 <br />Dear Mr. Kauffman: <br />This letter is in response to your application for a substitute water supply plan for the <br />Kauffman Pit in accordance with Section 37-80-120, C.R.S. (1991 Supp.). The required fee of $350 <br />for the substitute water supply plan and $60 for the well permit application has been submitted. <br />The anticipated net depletion for this plan is 27.27 acre-feet per year for the 24.3 acres of <br />lake surface exposed after December 31, 1980. According to information submitted, a portion of <br />the lake surface was exposed prior to January 1, 1981. The proposed plan does not provide for <br />replacement of the depletions from this area. There is presently a challenge to the statute whether <br />or not replacement is required for these depletions. Until this issue is resolved, I am willing to <br />accept replacement for the areas exposed subsequent to January 1,1981. There is a chance that <br />the resolution of this issue will eventually require replacement for all the exposed area. <br />You have provided a monthly breakdown of the annual depletion including 34.29 acre-feet <br />due to evaporative losses, 16.11 acre-feet credit for historic consumptive use, 5.14 acre-feet of <br />water in the product, 2.50 acre-feet used for dust control, 0.7 acre-feet used for material washing <br />and 0.75 acre-feet for stream carriage losses over 7 miles. <br />The proposed source of replacement is 35 acre-feet of water leased from the City of <br />Loveland in an agreement signed February 6, 1992. The source of the water provided by the City <br />of Loveland is transbasin Windy Gap water. <br />You have provided a monthly distribution for required water replacement. This plan's total <br />monthly replacement requirements in acre-feet are: <br />
