Hox 117 <br />Paonia CO 81428 <br />Re: Emission Permit 82DL343F(1-3) <br />Dear Mr. Chilton: <br />Your attention is directed to Section 25-7-114(4)(j) of the Colorado Air <br />Quality Cont m 1 Act, CRS, and specifically the Colorado Air Quality Control <br />Commission's Regulation No. 3, Section IV.H., which reads in part as follows: <br />If prior to final approval, the Division finds the terms or conditions of <br />the permit have been violated, it may revoke the permit or grant a period <br />of not more than six (6) months in which to meet the terms or condi- <br />tions... <br />Your attention is further directed to Initial Approval Emission Permit No. <br />82DL343-1F, and specifically the permit condition, xhich reads as follows: <br />3. Finished stockpiles shall not exceed 6,000 tons in aggregate with a <br />maximum of 2,000 tons fines at any time. <br />Finally your attention is directed to the Colorado Air Quality Control Act, <br />CRS, Section 25-7-114 (4)(j), which reads in part as follows: <br />"No person shall commence the operation of any project or the conduct of <br />any activity for which a permit has been issued without giving at least <br />thirty calendar days' prior notice to the division of the date on which <br />such commencement is to take place. Within thirty days after commence- <br />ment, the division shall inspect the project or activity to determine <br />whether or not the terms and conditions of the permit have been properly <br />satisfied.
