Chilton <br />April 19, 1984 <br />Page 2 <br />A final approval inspection was made by Mr. Scott Miller, a duly delegated and <br />qualified representative of the Colorado Department of Health, Air Pollution <br />Control Division, on April 13, 1984. On said date the coal sizing and loadout <br />facility subject to the above referenced permit xas observed in operation. <br />A review of Terror Creek Company's records revealed fines of 9,800 tons <br />presently on site. <br />Mr. Fredrick R. Chilton, General Manager, Terror Creek Company, was present <br />during the inspection and informed of the violation. It was indicated by Mr. <br />Chilton that the excess fines would be removed by August 1, 1984 due to <br />additional sales contracts recently obtained. <br />Pursuant to the above information, and as provided by Section 25-7-114(4)(j), <br />CRS, this letter will serve as official notice that the terms and conditions <br />of Emission Permit 82DL343 have been violated and grants Terror Creek Company <br />one hundred twenty (120) days in which to meet the terms and conditions of the <br />above referenced permit. <br />If you have any questions concerning this matter, please contact this office <br />at 248-7150, 222 S. 6th St., Room 232, Grand Junction CO 81501, or Mr. Dick <br />Fox, 4210 E. 11th Avenue, Denver CO 80220, Phone 320-4180. <br />Since sly, <br />i <br />Sc tt J.
