Minerals, C-81-037 <br />On Tuesday, July 28, 1992, Tom Gillis and I went down to G.E.C, for <br />the Pre-Bid Meeting on Section 24. Fifteen contractors, as well as <br />Dr. Corley, came down for the meeting. After walking over to the <br />Orphan Pit to review the cut and fill operation scheduled for that <br />location, Dr. Corley asked us to leave the property, since we were <br />unwilling to amend the bid document to accommodate his requests. <br />I would like to review the specific exchanges which occurred, so <br />you will be able to make informed decisions. <br />Tom and I arrived at 9:00, 1 1/2 hours prior to the meeting. We <br />hung a sign at the intersection of County Roads 15 and 92, and <br />continued south to look at the sediment pond removal task and the <br />West Pit gully repair task. After looking at the pond, we drove up <br />to Energy Fuels' Pond 5 embankment and saw Dr. Corley driving north <br />in an Audi sedan. I waved, and he returned to join us at the <br />embankment. <br />He was very concerned about Harrison-Western's maintenance work at <br />the West Pit; rains the previous weekend had resulted in the <br />merging of clean and dirty water, and flow of water off site <br />without treatment by a sediment pond. We indicated that we were <br />walking up to the West Pit and that he was willing to join us, but <br />that we had other objectives to achieve prior to the Pre-Bid <br />meeting. He invited us to join him in driving to the south edge of <br />the Energy Fuels disturbance area, but I told him that I was <br />uncomfortable being on an active mine site without a hard hat. We <br />approached the West Pit from two directions; we walked 1/3 mile to <br />the West Pit on the G.E.C. access road and he drove onto Energy <br />Fuels' facilities area. <br />We reviewed the instability of the drainage structures, indicating <br />that I would have Harrison-Western do additional work at the site. <br />He and I discussed the questions he asked in the July 27, 1992, <br />letter. I told him that G.E.C. had sized the pond at 1.2 acre- <br />feet, and that I had estimated that it contained 0.8 acre-feet. I <br />affirmed that we regularly allowed operators to use topsoil to <br />build berms on ditches, as a means of having adequate topsoil to <br />reclaim the ditch. He expressed concern about the resulting shale <br />at the bottom of the drainage leading into the sediment pond. He <br />wanted a legal description of Harrison-Western's area of <br />responsibility, and I told him that I had encouraged the lawyer to <br />put one together for the bond release package. I also indicated <br />that I didn't know if Harrison Western would push their legal <br />obligation to have a legal description. I excused myself to review <br />the gully repair task with Tom. <br />
