EILTS <br />565 Sanrlrock Dr. <br />Craig, CO 81625-2343 <br />(303) 824-8148 <br />June 26, 1992 <br />State of Colorado <br />Mined Land Reclamation bivision <br />Department of Natural Resources <br />1313 Sherman St., Rm. 215 <br />Denver, CO 80203-2273 <br />RE: Petition to resolve severe ar.'. or adverse reclamatiion <br />problems at Coal View ;hoeC xsnch <br />TO wxorf 1T MAY CONCERN: <br />This Petition is submitted to eliminate reclamation "f.oul-ups", <br />and other problems associated with activities conducted by Sun <br />Coal Company, (Meadows #1 Mine), Colorado Mined Land Reclama- <br />tion Division and the Colorado Mined Land Reclamation Board. <br />These problems have evolved as a result of experiments, destruc- <br />tion of roads, failure to restore airfield and an irrigation <br />ditch, failure to reclaim areas used and/or disturbed by Sun <br />Coal, The killing of wildlife and cattle, as well as the taking <br />of water, has materially affected our ranch operations. <br />Persons who were and are in the Departments forced the reclama- <br />tion of small areas, wliiCh had little or nothing to do with the <br />mining activities. These areas had been used by the land owner <br />since 1963, in the ranch operations. One area (which was re- <br />claimed last year), had not been reclaimed or ,ised by Sun Coal <br />at any time prior to this. Persona (CMLRD), refused to take <br />any action to restore areas, even though the land in question was <br />used or caused damage by Sun Coal Mining activities. Perjury <br />charges are being considered against one CAtLRD employee. <br />Our solution to the many problems will relieve the State of <br />Colorado and Sun Coal o£ all responsibilities for reclamation, <br />inspections, bonding, etc. It has been more than 10 years since <br />mining ceased and there are still no trees, and very, very little <br />brush to hold moisture, (in some areas no grass or vegetation of <br />any ki.nd). The compacted (cement like) reclaimed areas shed wa- <br />ter so effectively, killer water trenches are still being created, <br />
