JUN-30-92 NON 10;07 JACKSONS OFFICE SUPPLY FRX N0, 3038244027 P. 02 <br />-. <br />June 26, 1992 <br />Page 2 <br />RE: Petition <br />problems <br />to resolve severe and/or adverse reclamation <br />at Cnal View Ghost Rauch <br />Had the land been terraced and contoured as the Contract (Court <br />Order) mandated, Crees and brush would be in evidence, as is the <br />shop area now, even though the CMLRD people cannot see she 20' <br />tall trees, <br />Due to the fact that the load-out areas still must be reclaimed, <br />(EPA Regulations), and maintained for 10 years (as other areas <br />were), it will cost Sun Coal an estimated $240,000.00. Thia <br />may not include the Court Ordered fencing of all reclaimed areas. <br />y.`e would agree to accept all areas, except the pit area, as is <br />if Sun Coal would pay us the $140,000.00, in five years, :insr 3J <br />of the normal 10 year Contract. k'e would allow $10,000.00 for <br />equipment still on the property. <br />The Board forced us to accept the destroyed road, after less <br />than 5 years after it was gullied (reclaimed), This was done <br />in spite of our legal publication objecting to the proposed <br />changes. k'e at this time see no apparent reason or reasons <br />wliy the Board would not act on this request. <br />Therefore, we ask that the Board pass a Resolution or Act, as <br />necessary, to honor this Petition, <br />Faspectfully, <br />John A.
