(1), of the Rules and Regulations of the Colorado Oil and Gas Conservation <br />Commission ("COGCC"), Petroleum Development Corporation, Inc., ("PDC"), on behalf of Unioii, a <br />wholly owned subsidiary of PDC, as Operator, hereby gives notice to you that it intends to commence <br />operations for the drilling of a well or wells for oiUand or gas on the referenced lands no sooner than (30 <br />days). As surface owner you have the responsibility for notifying any affected tenant of the proposed <br />operations. <br />Prior to commencing these operations, we would like to consult with you concerning the proposed <br />operation and location of production facilities, pipelines and roads. The well location(s) will be staked <br />before the consultation, and I will be contacting you to discuss the proposed operations and to schedule an <br />on-site consultation, if you request one. You can reach me at (303) 517-3010. Enclosed is a postage <br />prepaid envelope containing a postcard or form letter, For your use in requesting a consultation. If you <br />wish to appoint a tenant for the consultation, please indicate the name, address and telephone number in <br />the spaces provided on the postcard or form letter- Please fill out the postcard or form letter and return it <br />to us within ten (10) days from the date of this letter. <br />The attached plat illustrates the area, per COGCC rules, orders or policies, within which the well(s) may <br />be located and the proposed location of the well. Also enclosed is a copy of the COGCC's brochure <br />describing surface owner rights and responsibilities and a copy of the COGCC's Policy for Onsite <br />Inspections. Individual copies of survey plats are also enclosed. <br />Per my recent phone conversations with Danny, your mine manager, he indicated that the State would be <br />coming out to the site soon (possibly on Thursday, Mareh 29'") for their monthly exam of the mine <br />reclamation. He suggested that if we could all three (yourself, Danny & I) be present at that exam that the <br />
