Rule 4.08.1(1) states that the operator shall comply with the requirements <br />of 4.08 in consultation with appropriate State agencies. With regard to the 0-entry shaft project, <br />the use of explosives is strictly regulated by MSHA due to the fact that an open airway to the <br />active mine will exist prior to the initiation of any blasting activities. All requirements of 30 CFR <br />Part 75 Subpart N regulating the use of explosives and blasting in underground coal mines will <br />be applicable at all times during this project. In addition, compliance with 30 CFR Part 75 <br />Subparts C and D (addressing roof control and ventilation respectively) will be required. <br />The 0-entry shaft development project will utilize explosives to enlarge a 5 foot diameter raise <br />bored shaft to a completed 18 foot diameter. The enlargement will occur first at the top of the <br />shaft and progress downward to the active mine. Cuttings will be directed down the 5 foot raise <br />bore into the mine. The initial shaft enlargement has been achieved utilizing a trackhoe. The <br />shaft has been enlarged to a depth of approximately 26 feet below the collar elevation of the <br />shaft in this fashion. Prior to initiation of the first blast, an A-frame support will be constructed <br />over the shaft and aplatform/hoist apparatus will be suspended in the shaft to facilitate <br />additional work within the shaft. This apparatus will remain in the shaft at all times until the <br />project is completed and will in effect act as a cover precluding the occurrence of flyrock from <br />the project site. <br />Due to the unique circumstances associated with the use of explosives in this instance, TCC <br />does not believe that strict application of all the provisions of Rule 4.08 is warranted. <br />Specifically, TCC does not feel the initial round of explosives fired can accurately be construed <br />as a "surface blasting activity" given the existing open airway to the active mine and the <br />commensurate MSHA required adherence to underground blasting regulations.
