<br />Mr. Kent Gorham <br />June 1, 1995 <br />Page 2 <br />facts that the shaft will be covered and the initial shot will occur 26 feet below grade in a <br />confined and strictly controlled setting do not support the interpretation of this activity as <br />"surface blasting". <br />To effect compliance with Rule 4.08, TCC has consulted with the Division in accordance with <br />Rule 4.08.1(1) and determined that the public notice provisions of Rules 4.08.1(2) and 4.08.3 <br />are applicable as more than 5 pounds of explosives will be utilized in each of the blasting <br />projects planned. Consequently, TCC has published the required blasting schedule in <br />accordance with these rules. TCC is enclosing MSHA approved plans pertaining to the <br />execution of the 0-entry project which effectively fulfill the requirements of Rules 4.08.1(3) and <br />(4). The requirements of Rule 4.08.1(3) are fulfilled by item 7 of the "Permit For Firing More <br />Than 20 Boreholes And For The Use Of A Nonpermissable Blasting Unit" dated 2/8/95. The <br />requirements of Rule 4.08.1(4) are fulfilled by information contained in the "Shaft Construction <br />Plan" dated 3/24/95. <br />With respect to the batch weigh system reclaim tunnel construction project, TCC will utilize <br />experienced, trained, and, competent persons in accordance with Rule 4.08.1(3). The <br />anticipated blast design requirement of Rule 4.08.1(4) is not applicable in that the project site is <br />not located within 1000 feet of any specified building or within 500 feet of an active or <br />abandoned underground mine. The project site is however, located immediately adjacent to <br />currently active TCC owned coal handling facilities consisting of an overland belt and the Tipple <br />#2 crushing and rail loadout area. Consequently, the magnitude of the anticipated blast will be <br />limited to prevent damage or disruption of activities at these facilities. The remaining <br />requirements of Rule 4.08 will be adhered to as applicable. <br />Thank you for your cooperation in this matter.
