Long, <br />Drv¢ion Drtector <br />During the June 17th and 18th complete inspection of the Marr Strip Mine, two permitting <br />deficiencies were discovered. The deficiencies are caused by the omission of two sections <br />of roadway from the Marr Strip mine permit. Both roads are used exclusively by the mine <br />for coal mining activities and are not public roads. <br />The Division noted that the haul road from Jackson County Road 14 to the loadout was not <br />included in the permit area. This section of road is about .4 miles long and serves as the <br />haul and access road to the loadout. The Division is requiring that this section be permitted <br />as a haul road. <br />The second deficiency involves the section of access road from the intersection of Jackson <br />County roads 12, 12a, 29 and the mine access road located in the northeast portion of the <br />permit area. This sectiorl of access road was previously identified as county road 12e. <br />Jackson County, in an agreement with Kerr Coal Company, abandoned this section of road. <br />Kerr agreed to take over the maintenance and to reclaim the road upon closure. The <br />Division is requiring that this section be permitted as an access road. <br />Although these roads existed prior to current mining activities, they are required to be <br />permitted since their use meets the definition of "surface coal mining operations" (Rule <br />1.04(132(b))). This Rule includes in the definition, ...all lands affected by the <br />construction of new roads or the improvement or use of existing roads to gain access to the <br />site ...." Rule 1.04(111) exempts public roads from consideration as a mine roads. Since <br />both these roads are not public roads this exemption does not apply. <br />
