Uram ~ ~~ <br />Director, Office o ^'r~a`c ~M' ing e~lamatton and Enforcement <br />Subject: Recommendation for Approval with a Condition of the Mountain Coal <br />Company's West Elk Mine Mining Plan for Federal Lease COC-54558, <br />Gunnison and Delta Counties, Colorado <br />I recommend approval with a condition of the Mountain Coa] Company's West Elk Mine <br />mining plan for Federal lease COC-54558 pursuant to the Mineral Leasing Act of 1920, as <br />amended. Approval of this mining plan supplements the West Elk Mine mining plans for <br />Federal leases C-0117192, D-044569, C-1362 approved on July 15, 1981 and modified on <br />August 16, 1985, September 27, 1985, November 21, 1987, and December 22, 1989. My <br />recommendation to approve the West Elk Mine mining plan is based on: (1) Mountain Coal <br />Company's complete permit application package (PAP), (2) compliance with the National <br />Environmental Policy Act of 1969, (3) documentation assuring compliance with applicable <br />requirements of other Federal laws, regulations, and executive orders, (4) comments and <br />recommendations or concurrence of other Federal agencies, and the public, (5) the findings <br />and recommendations of the Bureau of Land Management with respect to the resource <br />recovery and protection plan and other requirements of the Federal lease and the Mineral <br />Leasing Act, and (6) the findings and recommendations of the Colorado Division of Minerals <br />and Geology with respect to the PAP and the Colorado State program. <br />The Secretary may approve a mining plan for Federal leases under 30 U.S.C. §§ 207(c) and <br />1273(c). Pursuant to 30 CFR Chapter VII, Subchapter D, I find that the proposed mining <br />plan will be in compliance with all applicable laws and regulations.
