Recommendation <br />• I recommend approval with a condition of the West Elk Mine <br /> mining plan for Federal lease COC-54558. Approval of this <br /> mining plan supplements the West Elk Mine mining plans for <br /> Federal leases C-0117192, D-044569, C-1362 approved on July <br /> 15, 1981 and modified on August 16, 1985, September 27, <br /> 1985, November 21, 1987, and December 22, ].989. My <br /> recommendation is based on: (1) Mountain Coal Company's <br /> (MCC) complete permit application package (PAP), (2) <br /> compliance with the National Environmental Policy Act of <br /> 1969, (3) documentation assuring compliance with applicable <br /> requirements of other Federal laws, regulations, and <br /> executive orders, (4) comments and recommendations or <br /> concurrence of other Federal agencies, and the public, (5) <br /> the findings and recommendations of the Bureau of Land <br /> Management with respect to the resource recovery and <br /> protection plan and other requirements of the Federal lease <br /> and the Mineral Leasing Act, and (6) the findings and <br /> recommendations of the Colorado Division of Minerals and <br /> Geology with respect to the PAP and the Colorado State <br /> program. <br /> Approval of this mining plan will authorize mining of <br /> approximately 10 million tons of Federal coal within the <br /> approved mining plan area covering 1,012 acres within <br />. Federal lease COC-54558, as shown on the maps included with <br />this decision document. The U.S. Fish and Wildlife Service <br /> requested that the mining plan be approved with a special <br />
