Each of your concerns is briefly described, and addressed in the same order as <br />your letter. <br />Water bazs at the south end of the East Pit were located on a steep section of road <br />that originated on the west side of the pit, neaz the south topsoil stockpile. It <br />crossed the drainage above the original highwall and connected the east side of the <br />pit with the west. Construction of this road was not necessary, other than for <br />convenience of the contractor, and it was not part of the project work description. <br />To avoid serious erosion of the slope where the road was located, the contractor was <br />asked to install several water bars prior to revegetation of the site. This restoration <br />is provided for under Task #1, Paragraph #2 of the Invitation ~ Bid, and no <br />payment will be made for this item. A"'O <br />Construction activity neaz Magpie Creek and the staging area resulted in coal <br />overburden spoil covering a small portion of undisturbed ground, south of the road, <br />on Energy Fuels permitted road right-of-way. The contractor was asked to grade <br />and topsoil this azea. This work was covered under Task #1 of the Invitation A~ <br />Bid and no payment will be made for this item. <br />Prior to construction of the north end road the contractor was told by Messrs. <br />H. Ranny, J. Nelson and J. McArdle, at various times, that the road was to be sloped <br />into the hill at no more than 2°. This was not done when the road was initially cut, <br />resulting in a second grading effort by the contractor. The Division of Minerals and <br />Geology will not make additional payment to remedy work items initially done <br />incorrectly. Payment for this item, and important part of Task #8, has already been <br />made. <br />A naturally occurring channel (ditch) at the south end of the east pit was not well <br />defined after the East Pit reduced east and west highwalls were connected.
