<br />Preston Meese <br />Page 2 <br />storms between 5/5/94 and 5/7/94 produced enough flow to wash away sand and <br />silt, exposing riprap occurring in the channel. Division of Minerals and Geology <br />personnel felt that the channel (ditch) thus developed needed more definition, and <br />asked the contractor to widen and shape the ditch. This work involved more than is <br />covered under Task #12, Paragraph C, and the Division of Minerals and Geology <br />will make payment for 2 hours of Cat time under Item #15 of the revised bid <br />schedule. <br />- On 5/11/94 it was decided to remove additional riprap and erosion mat from the <br />above mentioned ditch, and the contractor was verbally informed. A change order <br />reflecting this was written on 5/26/94. However, the contractor refused to sign it, <br />primarily because of the reduced time associated with removal of these items. Work <br />associated with producing riprap that was to be used for this ditch, such as leveling a <br />bench to sort and store riprap, and exploration for riprap, was done prior to the <br />change order. However no riprap was produced by this effort, primarily due to a <br />lack of boulders, and this effort was abandoned. Considering that no riprap was <br />produced, no payment will be made for this item. <br />- Three separate stockpiles of riprap are present at the north end of the East Pit, and <br />comprise some 165 cubic yards, by measurement. North to south they are as follows: <br />Stockpile #1, approximately 50 cubic yards, contains 25% pit RuK sand and <br />small rock; stockpile #2, approximately 70 cubic yards, is all oversize and does not <br />meet specifications; stockpile #3, approximately 45 cubic yards, is mostly within <br />specifications. A large portion of this material, which falls within specifications, will <br />be needed to complete the riprap portion of Chen's Hill Ditch, which is currently <br />unfinished. Compensation for any excess riprap, meeting specifications, will be made <br />after the Chen's Hill Ditch is completed to our satisfaction. <br />q~.-a <br />- Although the Invitation ~! Bid document makes no reference to stream flow <br />direction in relation to a concrete drop structure, it was verbally explained to the <br />contractor that the point of the V is upstream. The contractor attributes the <br />misorientation of the drop structures to a "misunderstanding". If the contractor had <br />any question whatsoever concerning the structure it was his duty to bring it to the <br />Project Manager's attention, as required in Paragraph #11, p. 6 of the General <br />Conditions. Because of the incomplete description in drawing #3, the Division of <br />Minerals and Geology will pay one-half of the requested amount, or $400.00. <br />- Interest ??? <br />- After examination of the contractor's second invoice, it is difficult to understand <br />allegations that CDMG has withheld retainage twice. Retainage is held for all items <br />for the duration of the project as described in Paragraph #29, p. 11 of the General <br />
