Cf IP g'iiii?I ~ii50.''!: i:f <br /> <br />As you are aware because of the golden eagle nest <br />SW; of SE; of Section 17 T4N R86W) below the ridge in Are <br />Yampa Coal Company (CYCC), the USFWS was concerned about <br />blasting. This situation was discussed with CYCC and as <br />technical revision approval for mining in Areas 9 and 10 <br />following stipulation was added to the approval: <br />August 4, 1983 <br />(located in the NW; of <br />'as 9 & 10 at Colorado <br />the close proximity of <br />a condition of the <br />(February 11, 1983) the <br />CYCC SHALL NOTIFY THE DIVISION AND THE U.S. FISH AND WILDLIFE SERVICE <br />WHEN 6LASTING FROM THE PROPOSED MODIFICATION IS WITHIN 1,000 FEET OF <br />THE ACTIVE EAGLES NEST. <br />As you are also aware, CYCC did notify the USFWS concerning the blasts <br />via telephone Dave McMindes (CYCC) to Mike Lockhart (USFWS) on March 7, 14 & 24) <br />and because the JSFWS was unable to monitor the above mentioned eagle nest during <br />the blasts, I and other CYCC personnel monitored the nest during blasting at your <br />request. Please find enclosed a brief report of the results of that monitoring <br />and the associated map. <br />In summary, blasting as close as 550 ft. from the active eagle nest <br />during incubation and brooding did not interrupt nesting success and 2 young <br />apparently fledged from the nest. <br />If you have any questions, please call. <br />Sin rely <br />Terrell K.
