Long <br />Drvoinn Direcwr <br />The Division of Minerals and Geology (Division) has reviewed the permit revision application <br />materials submitted for Seneca Coal Company's (SCC's) proposed Seneca II-W South <br />Expansion Area. This letter presents the Division's adequacy questions, which are organized by <br />the pertinent sections of the Rules and Regulations of The Colorado Mined Land Reclamation <br />Board. <br />The Division has the following adequacy comments. <br />2.03 Minimum Requirements for Legal, Financial. Compliance and Related information <br />A check of the AVS has turned up a "conditional issue" for Seneca Coal Company. The <br />company has been linked to seven violations, six of the violations are from Kentucky and <br />one is from West Virginia. Seneca does not have to own or operate the mine that has <br />received a violation in order for Seneca to be linked to the violation. According to <br />Colorado regulations, the link to a violation can occur because an individual in one <br />company was related to another company which had received the violation. <br />The Kentucky violations involve a company called Catawba and have been covered <br />previously in permit stipulations for the three Seneca mines. However, the West Virginia <br />violation, which involves the company called Martinl:a, is new and needs to be added to <br />the stipulations. The Division will revise the appropriate stipulations for the three Seneca <br />mines and contact Seneca about these revisions. <br />
