f <br />iii iiiiiiiiiiiiiiii <br />999 <br />DATE: August 28, 2001 <br />TO: David Beny <br />FROM: Dan Mathews <br />RE: Powderhom Coal Company <br />Phase 1 Bond Release Evaluation <br />Permit C-81-041 <br />The purpose of this memo is to provide a status report on the Phase I Bond release application submitted <br />by Powderhom Coal Company (PCC) for the Roadside North and South Portals Mine (Roadside). First, a <br />brief chronology: <br />I. DMG received the bond release application on May 21, 2001. The applicant requested phase I <br />bond release for 47.1 acres, including South Lease Exploration sites, the North Decline reclaimed <br />area, reclaimed lower benches of CRDA-I and CRDA-2 refuse areas, the reclaimed South Fan <br />site, the reclaimed 2-West Portals Site, the reclaimed Cameo Borrow Area 1 site (CBA-I ), and the <br />overland conveyor. <br />2. On June 18, 2001, DMG notified the operator by letter that the application was determined to be <br />incomplete, because the required proof of publication had not been provided. DMG included a <br />"Phase 1 Bond Release Preliminary Review" as an attachment to the incompleteness letter. The <br />adequacy review identified 9 deficiencies in the initial application. <br />3. The applicant provided the required proof of publication on June 22, 2001. <br />4. An amended application addressing the adequacy issues was received by DMG on June 29, 2001, <br />and the application was deemed complete on July 12, 2001. Completeness notices were mailed on <br />that date, and notices of bond release inspection were mailed (certified mail) to the operator, OSM, <br />and permit area surface landowners on July 25 and July 26. <br />5. The bond release inspection was held as scheduled on August 14 and August I5, 2001. 1 <br />conducted afollow-up inspection on August 24, 2001, to verify completion of requested <br />maintenance work in a couple locations. 1 consider the August 24 site visit to be a continuation of <br />the bond release inspection, since it was done to follow up on concerns identified during the <br />inspection on the 14~' and 15~'. BLM participants had been invited to attend the follow-up <br />inspection, but declined. <br />The amended application <br />The amended bond release application included a cover letter that addressed each adequacy item identified <br />by DMG in the letter of June 18, along with revised application form, and various new or amended tables, <br />maps, cross-sections, and other documentation. <br />The "description of results achieved" section of the application form, included the statement that: <br />
