Box 176 <br />Oak Creek, Colorado 80467 <br />RE: Edna Mine (C-80-001) <br />Technical Revision No. 36 <br />Facilities Retention Request <br />Dear Mr. Beverlin: <br />The Division has completed a preliminary adequacy review of the materials sLlbmitted in support <br />of the above captioned technical revision. I apologize for the delay in completing this review. <br />We have the following questions and comments as a result of our review. <br />1. Retention of the facilities would not be permissible under the cLlrrently approved post- <br />mining land use of rangeland and wildlife habitat. If P&M wishes to retain the facilities, <br />the post mining land use will have to be changed. Based on P&M's description of the <br />proposed use for the facilities (support of a ranching operation), the Division believes a <br />land use of commercial might be more appropriate. If P&M decides to pursue a land use <br />change, this could be done in one of the following ways: <br />a) Amend the current revision (TR 36) to include a proposed land use change. <br />P&M would need to publish another newspaper notice indicating that the revision <br />being reviewed has been modified, with <t description of the proposed change. <br />b) P&M could apply for a separate technical revision for the land use change, and <br />waive the decision deadline on TR 36 until tl3e land tlse revision is final. <br />c) P&M could withdraw TR 36 and submit ~l new revision application for apost- <br />mining land use change and retention of tl3e facilities. <br />A proposed land use change revision should include the information required by Rules <br />2.05.5 and 4.16.3, addressing comments from landowners and local government agencies <br />and feasibility of the postmining land use. <br />2.
