Y,, <br />Charter Oak Coal Company is the owner of the land on which these structures are <br />located. If the land is not owned by P&M (Chevron), P&M must provide the Division <br />with a written consent of the landowner for retention of these buildings, as required by <br />Section 2.05.5(1)(b) of the Rules and Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining (Rules). It appears that the shop/warehouse area <br />is owned by P&M (Chevron). If this is not the case, then P&M must also provide a <br />written consent from that landowner as well. <br />3. Should the Division approve retention of the proposed facilities and storage yards, it <br />would be with the stipulation that the proposed use of them must be implemented within <br />two years of approval. If the use is not implemented, permanent retention will no longer <br />be approved, and reclamation to the approved postmining land use would be required. <br />Accordingly, P&M would be required to reserve topsoil for this area until the proposed <br />use has been implemented. The Division would retain performance bond coverage, in <br />accordance with Section 3.03.1(3)(e), for reclamation of the areas until the postmining <br />land use has been implemented. <br />4. The current sediment and erosion control methods employed for the facilities areas are <br />a combination of gravel surfacing and sedimentation ponds. [t is not clear in the <br />application for this revision whether P&M intends to retain the gravel surfacing. If the <br />gravel surfacing is removed, P&M must vegetate the area in the interim period between <br />the close of mining operations and resumption of the cattle operation.
