Canany <br />Division Director <br />Natural Resource Trustee <br />The Division has conducted a completeness review of the referenced bond release <br />application, and we have determined the application to be incomplete at this time. <br />Pursuant to Rule 3.03.2(1)(d), we are advising you of our incompleteness determination. <br />Please review the comments below, and amend the application as appropriate, or <br />otherwise provide information that will allow us to determine that the application is <br />complete. <br />We have the following concerns that need to be resolved in order for us to determine the <br />application to be complete, pursuant to 3.03.2(]). <br />There are a number of facilities included in the shaded area of the bond <br />release map (Exhibit A), which have not been regraded to date and/or have not <br />been approved as permanent facilities. As such, the areas are not properly <br />included in the Phase 1 bond release application. These facilities need to be <br />clearly excluded from the bond release request area depicted on Exhibit A. <br />Specific areas of concern include: <br />• The "Ranch Road" leading from the Ridgeline Access Road to the Main <br />SLbstation. Note that the road is denoted on the map as a Permanent <br />Road, however the road has not been identified or approved as a <br />permanent road in the permit, and the designation as a permanent road <br />needs to be removed. <br />The Main Substation facility and (apparently) a portion of adjacent <br />Topsoil Stockpile L. These facilities are apparently still in place, and the <br />disturbed areas have apparently not been regraded. Note that there is a <br />Office of <br />Mined Land RE~clamation <br />Office of <br />Active and Inactive Mines <br />Colorado <br />Geological Survey <br />
