Long <br />Nucla, Colorado 81424 2Gd15(Oil ~R-0~ Division Director <br />RE: West End Gravel Pit, Permit No. M-1994-011, Technical Revision No. 2 Adequacy Review <br />Dear Mr. Sutherland: <br />On March 18, 2002, DMG received the appropriate fee for West End Gravel Company's application for <br />Technical Revision No. 2 (TR-02) to the above noted permit addressing changes to the seeding plan <br />and fencing requirements. On that date the application was considered to be filed with DMG and was <br />set for technical adequacy review. TR-02 can not be approved until the following concerns are <br />addressed. Please submit your response to the following concerns as soon as possible, but no later <br />than April 15, 2002, so the decision date set for April 17; 2002 can be met. <br />ADEQUACY COMMENTS <br />As we discussed by phone several times, DMG will require a statement from Mr. Glasier <br />committing to keep all livestock off of the permit area until DMG, in consultation with the NRCS, <br />approves the site for grazing, or until the site is released from reclamation responsibility. Without <br />this statement, the proposed fencing plan will not be acceptable and the required financial warranty <br />will include costs for fencing the site as specified in the latest reclamation cost estimate mailed fo <br />you on January 17, 2002. <br />2. The letter from Mr. Glasier dated February 10, 2002 indicates that the fences on the east and west <br />side of the site need repair. Costs for fencing repairs will be included in the required financial <br />warranty amount unless Mr. Glasier commits to performing the fence repairs at his expense, prior to <br />any reseeding of the site. <br />3. Please specify a seeding rate, in pounds of pure live seed per acre, for the oats proposed by Mr. <br />Glasier. <br />4. The fetter from Mr. Glasier must be notarized. <br />5. The seeding of oats is only appropriate on the flat areas of the site. Please clarify this fact and <br />specify that the pit slopes will be revegetated per the current approved plan. <br />These comments must be adequately addressed by April 15, 2002. No extension of this decision date <br />will be approved. The reclamation cost estimate will be revised upon approval or denial of TR-02 and a <br />financial warranty in that amount will be due within 30 days of the mailing date of that revised <br />reclamation cost estimate. This means that the financial warranty must be submitted to DMG <br />
