'~~ <br />Deaz Mr. Means: <br />I will address the Adequacy Issues in the order that you presented them. <br />1. As stated in the reclamation plan, no disturbed slopes will be steeper than 3:1. The applicant will <br />follow the land prepazation and seeding recommendations outlined in "Recommended Practices For <br />Reclamation Sites" provided by the Shavano Conservation District. <br />2. Regarding the State Engineer's comments: The operation will not expose ground water. The <br />operator and property owner met with Lynne Bixler of the local Water Resources Office on <br />12/2/2003 to discuss the seepage water in the existing pit. You already have a copy of the results of <br />that meeting. MVR and the operator met with Ms. Bixler again on 2/2104 for clarification of <br />comments from the first meeting. The operator will commit to covering the existing seep in the <br />existing pit area so that it exits the gravel layer at the edge of Pelton draw as it did before any mining <br />occurred at this site and is therefore not exposed ground water in accordance with Ms. Bixler's <br />recommendation. Future mining at the site will remain at least two feet above the elevation where <br />this seep occurred and will not expose any ground water. There are no ditches on the affected lands <br />that carry water for anyone but the applicant. There are no water bodies or sources on or neaz the <br />affected lands that will be affected by this operation and therefore the operation will not impact <br />existing water rights. No water will be provided from on site sources for dust suppression at this <br />site. Irrigation water for reclamation at the site is water decreed for that purpose and is owned by the <br />landowner. Storm water will not be impounded for more than 72 hours by this operation in <br />compliance with the State Engineer's policy. <br />3. Gravel will be mine to within 85 feet of the south and west boundazies as stated in the mining plan. <br />From there, the gravel will be mined in a cut and push method back to the 25 foot final setback. This <br />will allow the final 3:1 slope to be created without backfilling the entire high wall area. The operator <br />will commit to mazking these buffer zones adequately prior to mining in those areas. <br />4. The required statement has been inserted into Exhibit D. A copy is enclosed. <br />
