The decision date for your application is scheduled for May 29, 2006. <br />Therefore, I would appreciate a response from you on or before Apri121, 2006. (Your response should <br />include two (2) copies). Please be advised that your amendment application maybe deemed inadequate <br />and may be denied on May 29, 2006 unless the following adequacy review items are addressed to the <br />satisfaction of the Division. <br />6.4.4 EXIIIBIT D - Minine Plan <br />1. The Applicant mentions on page 4 of the Amendment Application form that gasoline, diesel, oils, ad <br />mixtures, and (ow pH soap will be used or stored within the permit azea. In conformance with rule <br />6.4.7(2)(c) please verify that the spill contaimnent and countermeasures plan in place at the operation will <br />continue to be used for all azeas to be petnritted, included the additional 7.74 acres to be pemritted under <br />the terms of this amendment. Please respond. <br />2. The mining & reclamation plans for the Larimer Pit specifies development of 12 unlined goundwater- <br />fed lakes and 2 lined water storage ponds. Please quantify for each of the 10 cells at the Larimar Pit the <br />reclamation tasks that remain to be completed, ie: volume of topsoil to be re-spread, acreage to be re- <br />vegetated, # linear feet of pit wall to be backfilled and graded to a 3:1 slope, total # lineaz feet of clay liner <br />to be installed (Pond 2). (It is the Division's understanding that the Office of the State Engineer has not <br />yet inspected and verified that Pond 2 is deemed adequate for permanent water storage. Also, Loveland <br />Ready Mix Concrete, Inc (LRM) may want to clarify any permitted acreage or reclamation tasks already <br />released from reclamation responsibility by the Division of Minerals & Geology). Please provide. <br />3. The Applicant has specified de-watering of Cells 8 and 10 prior to excavation. Accordingly, please <br />clarify the maximum pit acreage to be expected in each of the cells during mining. Unless otherwise <br />specified by the Applicant, the Division will assume a depth to groundwater of 6 feet below ground surface <br />for each cell.
