Lochhead
E.eculrvC Dvecbr
Pit, File No M-77-560, Amendment AM-OOl,p~`~~~„eta,
Legal Notice and Clarification of Adequacy
I have reviewed the latest responses of yours (dated Nov~amber 24,
1994) regarding the above-named application. I have a few
questions about parts of your responses, and a few ~~uestions
concerning the application in general.
1. There is a typographical error in the legal description
contained in the new public notices, in the number of the
township. Please ensure that it is corrected and a new series
of four notices begun. The end of the public revil:w period
should also be changed.
2. The materials you submitted to become part of the ~smendment
application were not submitted in sets of four copies, as
specified in the instructions and required by the Minerals
Rules. Please send more copies, and remember that tlhe county
must also have a current set of the materials for public
review.
3. The pond banks are planned to be 2:1 slopes. However, because
the plan is for the pond to be used for recreation, there are
additional reclamation specifications you should be .swore of.
Please refer to Rule 3.1.5(7), which states that recreational
ponds may have sloped banks of 2:1, except within 1:he range
from 5 feet above to 10 feet below the waterline, crhere the
maximum slope may be only 3: 1. And if swimming is to be
included in those recreational uses, the slope there may not
exceed 5:1 within that same 15-foot range. Please cl,srify how
you plan to slope the banks, in narrative and cros:a-section
diagrams. Please be aware that, as water levels rise after
the removal of the flume, the exposed portion of t:he banks
should have the proper slopes.
cont.
