This application is a conversion and amendment to
MLR Permit Nos. 78-9 and 78-10 and is submitted under Sections 34-32-110-(8) and 34-32-
112(8), Colorado Revised Statutes, 1983, as amended, and Rule 1.8 of the MLRB Rules and
Regulations. Permit No. 78-9 wili be retained and Permit No. 78-]0 will be dropped and the
mines known as Apache 9 and Apache 9A will be combined and known as Apache Mine.
Location and Access. The approximate center of the affected land is located four miles
southwest of Calhan, Colorado. Access is approximately 3 miles west ofCalhan on Highway 24
to the intersection of Soapweed Road and Highway 24; thence south 2 miles on Soapweed Road
to the northeast corner of the affected lands. Currently a farm road exists along the Section line
between sections 16 and 21. The farm road will be left intact after mining is complete.
Additionally, a North access road has been constructed to service the miue operations in
Section 16. This North access road and all et;ke~s other roads constructed for mining purposes
will be reclaimed unless otherwise requested by the landowner.
Cun•ent Conditions. Map Exhibit C shows the outline of the affected land, touching
land owners, topography, hydrologic factors and existing facilities. Map Exhibit I-1 depicts
current soil conditions, and Map Exhibit J-1 depicts current vegetation.
Mining for clay on this property began in 1962 and has been continuous since that time.
Areas of pre-law disturbance are shown on Map Exhibit C. Any of these areas that are
redisturbed for the purpose of mining will be reclaimed.
One farmhouse, several out-buildings, and a power line to the farmhouse occupy the site
at the present time. Mining and reclamation will not affect these structures adversely.
Geologic Setting, The materials to be mined aze from the Upper Dawson Formation.
At the mine site the Upper Dawson consists of lenticulaz and discontinuous beds of Flat-lying
clays, claystones, sand and gravel, all of varying thickness. In this application all materials to be
mined will be referred to as clay. Exploration drilling has indicated that several clay strata aze
useable.
Draft Revision Juty 1999
5
