LLC <br />Apri127, 2006 <br />Mr. Jim Stazk <br />Environmental Protection Specialist <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver CO. 80203 <br />/^ <br />RECEi'VED <br />MAY 012006 <br />~'rviaron of idinerais and Geology <br />Re: Oxbow Minim LLC, Permit No. C-1981-022 <br />TR-54 Application for Construction of Additional Licht Use Road, Drill Site <br />Construction and Drilling of Gob Vent Boreholes. <br />Dear Mr. Stark, <br />The purpose of this letter is to request Technical Revision No. 54 to the Oxbow Mining <br />LLC (OMLLC) Permit No. C-1981-022 for construction of eleven (11) additional gob <br />vent boreholes (GVB) for the Elk Creek Mine. <br />The Mine Safety and Health Administration (MSHA) continues to express concerns <br />about the potential for elevated levels of methane in the Elk Creek mine. Because of this <br />concern, MSHA is mandating the installation of gob vent boreholes to vent methane from <br />subsided long wall panel areas (gob). OMLLC anticipates the MSHA concerns will <br />dictate an ongoing program to install such boreholes into each successive panel of the Elk <br />Creek mine. <br />OMLLC has previously permitted initial programs (TR-46, 48 and 53) of twenty (20) gob <br />vent boreholes. The subject of this TR is to install eleven (11) additional boreholes and <br />associated light use roads. These particulaz activities will be conducted on US Forest <br />Service lands. The USFS has initiated their NEPA process with a Public Scoping Notice <br />dated March 13, 2006. The proposed program is summarized by the attached information. <br />Revised PAP text pages 2.05-31a and 2.05-SOa are attached to address this proposal. <br />Map 2.05-M1-General Facilities, sheet 6 of 6 is provided showing the location of the <br />additional sites. <br />A revised Exhibit 2.04-E3, Item 9 -Methane Drainage Well Information is included <br />summarizing the GVB program. <br />3737 Hwy 133 P.O.
