Long <br />Drvivon Director <br />On November 18, 1994, the Division of Minerals and Geology received <br />Powderhorn's Minor Revision (MR-24) to revised the Roadside Portals <br />mine plan. The Division deemed the application complete on <br />November 28, 1994 and submitted a preliminary adequacy review on <br />that same date. <br />After additional research regarding the minor revision, the <br />Division has determined that the mine plan change requested by <br />Powderhorn Coal Company should be submitted as a technical revision <br />to the permit. A technical revision, as defined in Section 1.04 <br />(136), "..includes, but is not limited to, increases in coal <br />production.." Powderhorn is requesting an increase from 1.1 tons <br />to 2.4 tons to be mined annually. This is considered to be a <br />substantial change in coal production and, therefore, meets the <br />definition of a technical revision. <br />The Division will grant a partial approval of the revision to <br />include the area within the 5-year mine plan (through 1/3/98) and <br />the projected life of mine operation. Exhibit 5 should be modified <br />to remove Sections 32 and 33 of Township 11 South, Range 98-West. <br />The revised text, noting the increase in coal production, will not <br />be approved under this minor revision. <br />Items to be included in the technical revision include, but are not <br />limited to: <br />1. Items 3, 4 and 7 in November 28, 1994 letter from DMG to <br />Powderhorn (under MR-24). <br />2. Current Air Emissions Permit for the Roadside North Portal. <br />3. Increase in coal production. <br />
