On November 18, 1994, the Division of Minerals and Geology received
Powderhorn's Minor Revision (MR-24) to revised the Roadside Portals
mine plan. The Division deemed the application complete on
November 28, 1994 and submitted a preliminary adequacy review on
that same date.
After additional research regarding the minor revision, the
Division has determined that the mine plan change requested by
Powderhorn Coal Company should be submitted as a technical revision
to the permit. A technical revision, as defined in Section 1.04
(136), "..includes, but is not limited to, increases in coal
production.." Powderhorn is requesting an increase from 1.1 tons
to 2.4 tons to be mined annually. This is considered to be a
substantial change in coal production and, therefore, meets the
definition of a technical revision.
The Division will grant a partial approval of the revision to
include the area within the 5-year mine plan (through 1/3/98) and
the projected life of mine operation. Exhibit 5 should be modified
to remove Sections 32 and 33 of Township 11 South, Range 98-West.
The revised text, noting the increase in coal production, will not
be approved under this minor revision.
Items to be included in the technical revision include, but are not
limited to:
1. Items 3, 4 and 7 in November 28, 1994 letter from DMG to
Powderhorn (under MR-24).
2. Current Air Emissions Permit for the Roadside North Portal.
3. Increase in coal production.
