Long <br />Division Dvecia <br />DMG Denver office received your submittal, dated 2/13/96, on 2/16/96 and forwarded it <br />to DMG Durango office on 2/25/96. The 2/13/96 letter to DMG Denver contained <br />application for Technical Revision to the Black Snag Pit and to the Cedar Point Gravel <br />Pit. <br />The application for TR-01 was found complete for the purposes of filing on 2/16/96. <br />Rule 1,9.1, requires DMG to approve or deny the application within 30 days of filing. <br />DMG decision due date is 3/17/96. <br />TR-01 is not adequate for DMG approval as originally submitted. Please respond to the <br />adequacy concerns identified in this letter prior to DMG decision due date to allow time <br />for DMG to complete its review process and approve the TR. If additional time is <br />required to respond to DMG adequacy issues, please request an extension to DMG <br />decision due date. <br />TR-01 Adequacy Issues <br />Rule 6,3.5(2i(a) requires that the Mining Plan Map outline and label the permit <br />boundaries, described in Exhibit A -Legal Description for all Limited Impact 110 <br />Operations. DMG considers the area bounded by the permit boundary to be analogous <br />to the affected area. The map submitted on 2/13/96, shows an affected area of only <br />5.9 acres even through the permit has been approved for 9.9 acres affected area. <br />Please clarify whether the Black Snag Pit will affect 9.9 acres, as approved in the permit <br />application, or 5.9 acres as stated on the Mining Plan Map. If the operation is to affect <br />9.9 acres, please submit a Mining Plan Map which shows 9.9 acres. Mining activities <br />conducted beyond the boundaries of the approved affected area are subject to Possible <br />Violation for mining without a permit. <br />
