Cottony <br />, <br />y Division Director <br />Re: The Shores, Amendment Approval, Permit No. M-1998-013, Revision No. AM-1 <br />Dear Mr. Gregg: <br />On March 11, 2003 the Division of Minerals and Geology approved the Amendment application submitted to the <br />Division on November 7, 2002, addressing the following: <br />Increase the mined area from 125 acres to 221 acres of the 309 acre parcel and modify the reclamation <br />plan to line the ponds and utilize the site for developed water resources area. <br />The terms of the Amendment No. 1 approved by the Division aze hereby incorporated into Permit No. M-1998- <br />013. <br />The conditions of the Division approval are noted below. Please note that all other provisions of Permit No. M- <br />1998-013 remain m full force and effect. <br />Stipulation No. Description <br />1 A reportable spill is a spill of any toxic or hazazdous substance (including spills of <br />petroleum products) within the mined land permit azea reportable to any Division of the <br />Colorado Department of Public Health and the Environment, the National Response <br />Center, the Colorado Emergency Planning Commission, any local Emergency Planning <br />Conmlission, local Emergency Planning Committee, or the State Oil Inspector. The <br />Mine Operator shall notify the Division of Minerals and Geology (DMG) of a <br />reportable spill within the mined land permit azea using the same timeframe required <br />by the permit, license, notice, statute, rule or regulation governing the reporting of the <br />spill to the other appropriate agency. Notice of a reportable spill shall be FAXed to: <br />Minerals Program Supervisor, Division of Minerals and Geology, FAX (303) 832- <br />8106. The FAX shall include atoll-back number of a responsible company official for <br />DMG staff to use a contact. <br />The Applicant shall provide an updated proof of Legal Right of Entry, to the <br />satisfaction of the Division, prior to the Applicant implementing the modifications <br />requested in the Amendment Application. <br />If the Operator intends at some point to request the 20 percent bonding option for <br />slurry wall installation, the following minor changes must be incorporated into the <br />slurry wall specifications.
