Cattany <br />Bayfleld, CO 81122 Division Director <br />Natural Resource Trus[ee <br />V V <br />Re: Ignacio Pit, Permit M-1992-054, 112c Conversion Application (CN-O1), Preliminary Adequacy Review. <br />Deaz Mr. Carnahan, <br />I have finished the adequacy review of the above-named conversion application, and have a few comments and <br />questions that must be addressed before the Division's decision date; the decision date is currently set for January <br />23, 2006. Some of the following items are included only to ensure that my interpretation is correct, and if it is, no <br />response is required from you. I have arranged the items below according to their location in the application and/or <br />exhibits. Please arrange and label your responses similazly to facilitate their review and inclusion in the <br />application. Items not included in this letter are considered adequate at this time. <br />Application pa eg 1 (replacement page, received 10/18/O5~ <br />The acreage figures provided indicate that this conversion seeks to add 130.1 acres to the existing 9.9 acres, for a <br />new total of 140.0 acres. Please be reminded that this figure is for permitted area, not affected area. Also, please <br />ensure that the full permitted acreage is correctly depicted on all new maps. <br />Exhibit C -Pre-mining and Minine Plan Maps (Rule 6.4.3) <br />The single map provided contains existing features as well as proposed boundaries and mining activities. As such, <br />this map could be considered to constitute both the pre-mining and mining plan maps. However, as the following <br />paragraphs explain, since there are numerous items which may require revised maps to be submitted, preparing two <br />different maps (pre-mining and mining maps) would be better. <br />Numerous properties, easements, and structures exist on or within 200 feet of the area proposed in this conversion. <br />Some of the easements and structures aze labeled with the owners' names, but not all of them. Please ensure that <br />owners of all structures, properties and easements are identified, as necessary, including gasline easements, gas well <br />access roads, waterline easement, state highway (label location needs to be moved), county roads, perimeter <br />fencelines, etc. If any of these items is owned by the applicant, please so indicate. (Additionally, the parties <br />identified on the map as owners of these items must all be individually notified of this conversion application. This <br />is discussed below, under "Other Items.") <br />The maps must contain a labeled permitted area boundary (delineating the proposed 140-acre area). If the affected <br />area is different, the maps must also contain an affected area boundary. <br />If mining is not planned to occur on the west side of the buried waterline, please clarify that on the revised map. <br />The mining map shows four separate mining phases (A-D).
