Please note [hat all other provisions of Permit No. M-1978- <br />305 remain in full force and effect. <br />Stipulation No. 1 Description <br />Until such time that it can be adequately demonstrated to the Division that the National Park Service <br />(NPS) has no jurisdiction in matters regarding the approved mining plan, the approved reclamation plan, the use <br />or disturbance of the site which is or will be affected under the different phases of the operation, or the <br />requirement for the operator [o obtain and maintain a Special Use Pernu[ (SUP) from the NPS for this operation, <br />the operator must continue to comply with the nursing and reclamation standards, specifications andlor limitations <br />set forth in the SUP which is in effect at the time. The Division's monitoring of the operator's compliance with <br />the SUP, as required by [his stipulation, is limited to only those aspects of the operation which lie within the <br />Division's jurisdiction. This stipulation will remain in effect as long as the NPS has jurisdiction in these matters, <br />to demonstrate the operator's compliance with Section 34-32.5-I 15(4)(t)(I), CRS. <br />Stipulation No. 2 Description <br />Initial operations in this 112 permit are approved [o be limited to the 12 acres identified in the file as Phase I. <br />Mining operations and reclamation must be carried out as specified in the DMG-approved plans and as specified <br />in the NPS-issued Special Use Pernut, so long as the SUP is required [o be in effect.
