(BMRI) decision to change analytical laboratories, I provide the following <br />responses to your questions or concerns. With regards to the analytical lowest method <br />detection limit (MDL} for the three constituents (i.e., cadmium, silver, lead) you <br />identified, the analytical lowest MDL's for the three constituents used in the analytical <br />laboratory "Request for Quotation" (RFQ) was taken from the San Luis Project <br />"Colorado Discharge Permit System" permit issued by the Colorado Depart>#tent of <br />Public Health and Envirotunent on December 8, 2000. As identified in Part I, page 18 of <br />that permit, the lowest MDL's requested in the RFQ were to comply with specified <br />analytical methodologies and minimum detection levels specified in and apptloved <br />pursuant to 40 C.F.R. part 136. In addition the bidding laboratories were given the <br />following specific permit conditions presented in the CDPS permit: <br />"When t{te most sensitive nnalvtiral method which complier with this part. has a <br />detection limit greater than or equal to the permit limit, the permittee shall report "less <br />t{tan "tlre detection limit, " as appropriate. Suc{t reports shall not be cottsid~red as <br />violations of the permit limit.
